A man is facing criminal charges after he allegedly attempted to ram the vehicles of two police officers with a front-end loader.
Flabio Herrera, 26, was arrested in the area of Eagle’s Nest and Vista Largo roads in Dexter Sunday. According to court records, he drove a Volvo Wheel Loader L 70 H toward two police officers — one from the Dexter Police Department and the other from Hagerman — in an attempt to hit their vehicles.
Court records state the officers were responding to a call that came in at 7:53 p.m. of a front-end loader driving erratically and damaging fences.
A Hagerman officer in his vehicle encountered the front-end loader when it came out of a field with its bucket raised and lights on. Court records state that when the officer activated the lights on his vehicle, the loader went toward the officer’s vehicle at full speed and forced the police vehicle to turn into a field to avoid being struck.
After hearing about the incident, an officer with the Dexter Police Department arrived and was driving behind the front-end loader when the machine turned around and started to go toward him.

Court records state the front-end loader attempted to sideswipe the Dexter police officer’s vehicle, prompting the officer to get out of the vehicle and run to the side of the road as the front-end loader advanced toward his vehicle.
The front-end loader then reportedly turned and attempted to drive toward the Dexter police officer, leading the officer to fire a single shot at the loader. Herrera was not injured and the round hit the front-end loader.
Herrera then exited the front-end loader. Court documents state Herrera tried to evade police by fleeing onto a property but was prevented from doing so by a locked gate. He was subsequently detained by the officers.
Chaves County Undersheriff Charles Yslas said because an officer discharged his weapon, the Chaves County Sheriff’s Office is investigating the incident. He added that Herrera is now charged with two counts of aggravated assault upon a peace officer, deadly weapon, but could face additional charges related to property damage.
Bond was set by Judge E.J. Fouratt for Herrera at $75,000 cash or surety bond, according to court records.
Electronic court records state that Herrera is currently awaiting trial in two other cases: one a July 2020 case on a charge of trafficking controlled substances, possession with intent to distribute; and the other on charges of armed robbery, conspiracy to commit armed robbery, and receipt, transportation or possession of a firearm or destructive device by a felon.
