YPSILANTI TWP., MI – A man accused of shooting at a 6-year-old boy out his window after telling him and his friend to get off his lawn is heading to trial on multiple felony charges.
Ryan Cuong Le-Nguyen was bound over for trial Thursday, Aug. 26, after a preliminary examination before Washtenaw County District Judge Joseph Burke.
Le-Nguyen is accused of shooting a 6-year-old boy, who lived next door to him, at about 4:30 p.m., June 6, after telling the boy and his friends to get of his lawn. The group threw a ball at his window while playing “monkey in the middle,”, according to witnesses who testified during the examination.
“This was a neighborhood dispute which had a horrific ending,” Burke said binding the case over to trial court. “From yelling at kids to get off his lawn to suddenly changing his mind that someone Is breaking in, to shoot first (and) call 911 later, that’s not how that is supposed to be. Even a 10-year-old knows that.”
Le-Nguyen, 29, now heads to trial charged with one count each of assault with intent to murder, assault with intent to do great bodily harm, discharging a firearm in or at a building, discharging a firearm in or at a building causing injury and three added counts of felony firearm.
Man charged with shooting 6-year-old in Ypsilanti Township
The victim -- along with two of the children, 10 and 11 -- testified the group were playing “monkey in the middle” with a ball when, at some point, the ball was thrown at Le-Nguyen’s home in the 1300 block of Candlewood Lane in Ypsilanti Township.
They said at some point Le-Nguyen exited the home, kicked the ball into the street and yelled that the group to get off his lawn while he was holding a hammer.
While one child retrieved the ball, the others went next door to get the victim’s older brother, 11, to tell him what happened.
The older brother and the victim knocked on Le-Nguyen front door moments before the victim splashed red Gatorade on the door and ran away, witnesses said.
As the group ran away from Le-Nguyen’s house, they heard a loud bang they all believed to be a gunshot. They soon discovered the boy had been shot through the back of his upper arm, inches away from his chest.
The children then ran home and told their parents who called 911 at about the same time Le-Nguyen called 911 reporting an alleged attempted break in.
The boy has since recovered from his injuries with only scars of a bullet entry and exit wound on his arm.
Le-Nguyen was arrested and, during interrogation, admitted shooting through his front window as “a warning shot” believing someone was trying to break in, Washtenaw County Sheriff’s Office Detective Jamie Stitt said.
He was aware there were children outside and was unaware he had hit anyone, she said.
He then disclosed the location of the gun used, a revolver, which was found alongside a hammerhead in a crawl space under floorboards of his second bedroom.
Beyond a bullet hole through his front window, no other damage was found at the home. Stitt noted seeing an empty Gatorade bottle laying on Le-Nguyen’s front porch.
Le-Nguyen’s attorney, Lillian Diallo, objected to the bind over, stating the hearing did not establish there was a clear intent to kill made and there are conflicting accounts of what happened.
Burke disagreed, stating intent will be a question for a jury.
Le-Nguyen’s case has been assigned to Washtenaw County Trial Judge Darlene O’Brien with a pretrial hearing set for Sept. 30. He remains detained in the Livingston County Jail with bond set at $100,000.
